We may terminate or suspend access to our Service immediately, without prior notice or liability if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Disclaimer of Liability

Injuries of all types can occur when participating in exercise, physical fitness and training programmes. This is particularly true if you are unused to regular exercise. We strongly recommend that you consult a doctor for advice with regards to the suitability of these Pilates courses, PRIOR to undertaking any of the exercises shown on this website.

Most of our video sessions explain how particular exercises may be made easier for when you are first starting out with that particular exercise. Others are specifically titled as Intermediate or Advanced courses.

If at any time whilst exercising you feel pain, STOP EXERCISING. If it hurts to perform the exercise then listen to your body and stop. Try reducing the severity of the exercise (stretch, bend number of continuous reps) and if the pain does not subside then stop and seek medical advice.

You fully assume the risk of any resulting injury. Such injuries include but are not limited to:

  • Muscle pulls and strains
  • Ligament damage
  • Tendon strains
  • Bruises, cuts & general soreness

In extreme cases where there are underlying health problems more serious injuries can result

  • Heart Failure
  • Broken bones
  • Concussion

Consequently your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

You indemnify and hold harmless F M Griffith against any loss, liability, damage, cause of action, cost, or expense of any nature whatsoever, including without limitation reasonable solicitors’ fees and other legal costs. We will not be liable for any consequential, indirect or special loss or damage, or any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
